CODE OF ETHICS

Introductory Provisions

1. This Code of Ethics governs the rules for uploading content and user behavior on the SexMiss.com platform (hereinafter referred to as “SexMiss.com”).

2. This Code of Ethics supplements the General Terms and Conditions (“GTC”) in accordance with the provisions of the GTC.

3. Unless otherwise stated, abbreviations used in this Code of Ethics have the same meaning as defined in the GTC.

Common Provisions for All Types of Content

1. Content, in accordance with the provisions of the GTC, refers to text, visual, audiovisual, graphic, photographic, or other similar material that can be downloaded, transferred, forwarded, or edited in a perceivable form (“Content”) uploaded to SexMiss.com.

2. All Content is subject to approval by the Operator or authorized persons before being published.

3. Any Content, including entire user accounts, ADS AND CHAT, may be reported after being uploaded/published on SexMiss.com by any person who has a legitimate legal interest. The Operator reserves the right to request evidence supporting the reporter’s claims. 4.Content must not:
1. Insult or attack individuals or groups of people;
2. Express hate, especially through the use of hate symbols or gestures, symbols denigrating human races, or otherwise violating public order;
3. Initiate or incite conflicts, arguments, violence, or riots;
4. Promote or incite topics prohibited by law or other legal regulations;
5. Sell, solicit, or link to the sale of illegal or regulated goods, either directly or indirectly;
6. Link or redirect users to other websites;
7. Act fraudulently or provide false information;
8. Violate copyright laws or intellectual property rights of the content creator or the personal rights of individuals depicted in the content, particularly (but not exclusively) through downloads from the internet or other publicly available sources;
9. Share contact information, except when explicitly allowed within designated areas of SexMiss.com. Contact information includes full name, phone number, email address, bank account number, or usernames on other platforms;
10. Create or share public lists of unwanted users 11. Repeatedly and unreasonably harass other users;
12. Depict or refer in any way to children or persons under 18, or persons giving the impression of being children, including avatars, drawings, anime, or other similar categories;
13. Depict or mention animals and sexual practices involving them in any way;
14. Depict or mention blood or anything resembling blood;
15. Contain visual, audio, or other watermarks differing from the watermark of SexMiss.com;
16. Be created solely by algorithms based on neural networks and/or language models (i.e., artificial intelligence), except for content enhanced or supplemented using such technology. 5. Violation of any of the above rules may result in the temporary deactivation, suspension, or complete deletion of the user’s account.
6. The Operator reserves the right to individually assess each piece of content and its placement on SexMiss.com.
7. A user who violates the GTC, the Code of Ethics, or any legal regulation, and as a result is deactivated, blocked, or removed, is not entitled to a refund or any compensation for purchased services, plans, or credits.

Rules for Text Content

1. Text content refers to text fields in the profile detail (such as profile text, address note, price note), listings in the directory, and CHAT MESSAGES.
2. The following is prohibited in text content:
1. Ridiculing, defaming, or systematically harassing other users or employees and collaborators of SexMiss.com;
2. Publishing information about victims of criminal offenses, even at the investigation stage, as well as information about ongoing proceedings before public authorities;
3. Including any text on the website that contains sexual practices, vulgarisms, names of genitals, or obscene language. Obscene language refers to words not listed in the Dictionary of Standard Czech;
4. Including in chat or site messages any racist or otherwise discriminatory texts, or texts inciting criminal activity, violence, terrorist attacks, or suicide.
3. Text content may not be used for announcing public fundraisers or similar appeals.
4. The length of text content may be limited by a minimum and maximum number of characters to ensure proper display and smooth text flow.

Text Content Rules for Advertisers

1. The advertiser is not authorized to upload content (especially images, texts, or photographs) via the web interface that:
1. Displays violence or incites hatred based on gender, race, skin color, language, religion or religious beliefs, political or other opinions, national or social origin, affiliation with a certain nationality or ethnic group;
2. May constitute conduct that abuses or restricts fair competition, causing harm to other parties—especially in the form of misleading advertising, deceptive labeling of goods or services, creating confusion, exploiting reputation, defamation, prohibited comparative advertising, or other similar actions;
3. Violates copyrights or intellectual property rights of the operator or third parties;
4. Contains contact details or information about another person that may be considered personal data, unless that person has given consent;
5. Contains false or misleading information about the offered goods;
6. Harasses other users of the web interface or interferes with their proper use of the operator’s services;
7. Is used in violation of legal regulations or promotes or approves such violations; 8. Is likely to disrupt the operation of the web interface or excessively burden it;
9. Contains an unjustified number of punctuation marks, asterisks, or similar symbols; or
10. Otherwise violates these terms, applicable laws of the Czech Republic, or standards of good morals.

Photo Guidelines

1. A photo displayed in the relevant catalog, on the homepage, and in the user’s profile detail is referred to as the Main Photo.
2. It is prohibited to use photos of other people as the Main Photo, especially of publicly known individuals, or any photos where there is a risk of confusing the person with someone else.
3. Photos uploaded by the user into the “Photos” tab must go through an approval process before being published on the website. This process is carried out by the Operator or authorized personnel.
1. Rejected Photo: The user has violated the General Terms and Conditions, the SexMiss.com Code of Ethics, or has not met the required file parameters or quality standards. The reason for rejection is communicated to the user via a notification in their profile.
2. Approved Photo: The photo is published in the user’s profile detail and in listings on SexMiss.com according to the selected plan or tariff.
4. Photos must be original and not reproduced or otherwise copied.
5. Visible genitals – These must be fully covered or obscured, not merely blurred.
6. Visible anus – This must also be fully covered or obscured, not merely blurred.
7. Visible female nipples – These must also be fully covered or obscured, not merely blurred. 8. Sexual activities, including:
1. Sexual intercourse;
2. Explicitly depicted sexual intercourse where mouth or genitals are in contact with or penetrate another person’s genitals or anus, and at least one person’s genitals are visible;
3. Contextually implied intercourse where mouth or genitals are in contact with or penetrate another person’s genitals or anus, even if the contact is not directly visible;
4. Contextually implied stimulation of genitals/anus, where genitals/anus are stimulated by inserting objects, even if such activity is not directly visible.
9. Other sexual activities, including:
1. Erection;
2. By-products of sexual activity;
3. Stimulation of genitals or anus;
4. Use of sex toys, whether over or under clothing;
5. Stimulation of exposed human nipples;
6. Squeezing female breasts (excluding breastfeeding contexts);
7. Fetish content, including:
• Acts likely to result in the death of a person or animal
• Dismembered body parts
• Cannibalism
8. Feces, urine, saliva, mucus, menstruation, or vomit

Disclaimer of Liability

1. The operator of SexMiss.com declares that no employment relationship arises between the operator and users using the portal.
2. The operator further declares that the opinions expressed by any users on SexMiss.com may not reflect the views and opinions of the operator and therefore cannot be considered as such.
3. The operator also declares that despite all efforts and due diligence, it is not possible to monitor all user communication on the website.
4. The operator is not responsible for the behavior of individual users on the website, especially activities violating the law, third-party rights, copyright, or privacy and freedom protection laws.
5. The operator reserves the right to monitor texts and other content published on SexMiss.com for the purpose of ensuring safety and rule compliance.

Final Provisions

1. This Code of Ethics becomes effective on October 22, 2024.
2. The operator reserves the right to unilaterally amend this Code of Ethics.
3. In the event of discrepancies between different language versions of this Code of Ethics, the Czech version shall prevail.
