This Code of Ethics governs the rules for uploading content and the rules of conduct for users on the SexMiss.com platforms (hereinafter referred to as ‘SexMiss.com’).
This Code of Ethics supplements the General Terms and Conditions (‘GTC’) in accordance with the provisions of the GTC.
Unless otherwise stated, the abbreviations used in the Code of Ethics are the same as those used in the GTC.
Common provisions for all types of content
In accordance with the provisions of the GTC, ‘Content’ means text, visual, audiovisual, graphic, photographic or other similar content that can be downloaded, transferred, forwarded or modified in a form perceptible to the senses (‘Content’), uploaded to SexMiss.com.
All Content is subject to approval by the Operator and persons authorised by the Operator prior to publication.
All Content, including entire user accounts, may be reported after being uploaded and published on SexMiss.com by any person who expresses a legal interest in doing so; the Operator reserves the right to request evidence to support the reporter's claim.
Content must not
insult or attack individuals or groups of persons;
express hatred, in particular through hateful symbols and gestures, symbols that defame a human race or otherwise violate public order;
initiate or incite conflicts, arguments, violence or riots;
initiate or incite topics prohibited by law or other legal regulations;
sell, solicit or refer to the sale of illegal or regulated goods, either directly or indirectly;
refer or direct users to other websites;
act fraudulently or provide false information;
infringe the copyright and intellectual property rights of the author of the Content or the personality and other rights of persons depicted or otherwise appearing in the Content, including, but not limited to, downloading from the Internet or other publicly available sources;
provide contact details, with the exception of elements expressly designated for this purpose on SexMiss.com, whereby contact details are understood to mean, in particular, full name and surname, telephone number, email address, bank account number and username on another platform;
create or publish public lists of undesirable persons;
repeatedly harass other users;
depict or mention children or persons under the age of 18 or persons who appear to be children, including in avatars, drawings, anime and other similar categories;
depict or mention animals and sexual practices with them in any way;
depict or mention blood and anything similar to blood in any way;
bear a watermark, sound or other mark different from the SexMiss.com watermark;
be created using algorithms based on neural networks and/or language models (so-called artificial intelligence), with the exception of content that has been improved or supplemented using this technology.
Violation of any of the above rules may result in the temporary deactivation, blocking or complete deletion of the user's account.
The operator reserves the right to individually assess each piece of Content and its placement on SexMiss.com.
A user who has violated the Terms and Conditions, Code of Conduct or other regulations and has been deactivated, blocked or deleted in any way as a result of such violation is not entitled to a refund or compensation for any services purchased.
Text content rules
Text content means the text fields in the profile details (profile text, address note, price list note), and the ad on the dating site.
The following is prohibited in text content
ridicule, slander or systematically harass other users and employees and associates of SexMiss.com;
publish information about victims of criminal offences, even at the stage of investigation, and information about ongoing proceedings before public authorities.
Do not use words that contain sexual practices, vulgarities, names of genitals or swear words in any text posted on the website. Swear words are understood to be words that are not listed in the dictionary of standard English.
Text content may not be used to announce public collections or similar calls.
The length of text content may be limited by a minimum and maximum number of characters to ensure correct display and text flow.
Rules for photographs
The photograph displayed in the relevant catalogue, on the HomePage and in the user's profile details is called the Main Photograph.
It is prohibited to use photographs of other persons, especially publicly known personalities, or photographs that could be confused with another person as Main Photographs.
Rejection of a photo: the user has violated the General Terms and Conditions, the SexMiss.com Code of Conduct or has not complied with the prescribed file and photo quality parameters; the user is informed of the reason for rejection via a notification panel in their profile;
Approval of photos: After approval, the photo is published in the user's profile details and in the list on SexMiss.com according to the settings and selected tariff;
Photos must be original, not reproduced or otherwise taken from another source.
Visible genitals – This means that they must be completely covered or obscured in the post, not just blurred!
Visible anus – This means that it must be completely covered or obscured in the post, not just blurred!
Exposed female nipples – This means that they must be completely covered or obscured in the post, not just blurred!
Sexual activities including:
Sexual intercourse
Explicit sexual intercourse, where the mouth or genitals are in contact with or penetrate the genitals or anus of another person and the genitals of at least one person are exposed
sexual intercourse implied by context, where the mouth or genitals are in contact with or penetrate the genitals or anus of another person, even if such contact is not directly visible
stimulation of the genitals/anus implied by the context, where the genitals/anus are stimulated by inserting objects into the genitals/anus, even if such activity is not directly visible
other sexual activities, including but not limited to:
erection
by-products of sexual activity
stimulation of the genitals and anus
use of sexual aids, whether over or under clothing
stimulation of uncovered human nipples
squeezing of female breasts (not applicable in the context of breastfeeding)
fetishistic content, which includes:
acts likely to result in the death of a person or animal
separated body parts
cannibalism
faeces, urine, spitting, mucus, menstruation or vomit
Disclaimer
The operator of SexMiss.com declares that no employment relationship arises between the operator and the user through the use of the portal.
The operator further declares that the opinions of any persons expressed on SexMiss.com may not be in accordance with the position and opinions of the operator and therefore cannot be considered the opinions of the operator.
The operator further declares that despite all efforts and necessary care, it is not possible to monitor all user communication on the website.
The Operator is not responsible for the behaviour of individual users on the website, in particular for activities that violate the law, the protection of third-party rights, copyright law and the protection of privacy and freedom.
The Operator has the right to monitor texts and other content published on SexMiss.com for the purpose of ensuring safety and compliance with the rules.
Final provisions
This Code of Ethics shall take effect on 22 October 2024.
The operator reserves the right to unilaterally amend this Code of Ethics.
In the event of a conflict between the individual language versions of this Code of Ethics, the Czech version shall prevail.
